Welcome to AllOpen ("we," "our," or "us"), a social platform managed by Allpixel Technologies. These Terms of Service ("Terms") govern your access to and use of our website (allopen.in) and mobile application (collectively, the "Service").

By accessing or using AllOpen, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using AllOpen, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms.

If you are using AllOpen on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

• You must be at least 13 years old to use AllOpen. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent's or guardian's permission to use the Service.
• You must be legally capable of entering into binding contracts.
• You must not be prohibited from using the Service under applicable laws.
• You must not have been previously banned from using AllOpen for violating these Terms.

3. Account Registration and Security

3.1 Account Creation

• To use certain features of AllOpen, you must create an account by providing accurate, current, and complete information.
• You may choose to use an anonymous name or display your real name on your profile.
• You are responsible for maintaining the confidentiality of your account credentials (username and password).
• You agree to notify us immediately of any unauthorized access to or use of your account.

3.2 Account Responsibility

• You are solely responsible for all activities that occur under your account.
• You must not share your account credentials with any third party.
• You must not create multiple accounts to evade restrictions or bans.
• You must not use another user's account without their permission.

4. User Content and Conduct

4.1 Your Content

• You retain ownership of all content you post, upload, or share on AllOpen ("User Content").
• By posting User Content, you grant AllOpen a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and providing the Service.
• You represent and warrant that you own or have the necessary rights to all User Content you post and that such content does not violate any third-party rights.

4.2 Prohibited Content and Conduct

• Is Illegal: Violates any applicable local, state, national, or international law or regulation.
• Is Harmful or Dangerous: Promotes violence, self-harm, suicide, or dangerous activities.
• Is Hateful or Discriminatory: Contains hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Is Defamatory or Libelous: Contains false statements that harm someone's reputation.
• Is Spam or Unauthorized Advertising: Includes unsolicited promotional content, spam, or commercial messages without our prior written consent.
• Infringes Intellectual Property: Violates copyright, trademark, patent, or other intellectual property rights of others.
• Is Sexually Explicit: Contains pornography, nudity, or sexually explicit content (except as permitted by our Community Guidelines).
• Is Personal Information: Discloses private or confidential information about others without their consent.
• Is Malicious: Contains viruses, malware, or code designed to harm or disrupt systems.
• Is Impersonation: Impersonates another person, entity, or organization.
• Is Manipulated Media: Contains deepfakes or manipulated media intended to deceive.

4.3 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws.
• Harass, bully, threaten, or intimidate other users.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Use automated systems (bots, scrapers) to access the Service without our permission.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Collect or harvest information about other users without their consent.
• Use the Service to transmit spam, chain letters, or unsolicited communications.
• Engage in any activity that could damage, disable, or impair the Service.

5. Intellectual Property Rights

5.1 Our Content

• AllOpen and its original content, features, and functionality are owned by Allpixel Technologies and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
• You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.
• The AllOpen name, logo, and trademarks are the property of Allpixel Technologies.

5.2 Your Content

• You retain all ownership rights to your User Content.
• By posting User Content, you grant us the license described in Section 4.1.
• You are responsible for ensuring that your User Content does not infringe on the rights of others.

6. Privacy and Data Protection

Your use of AllOpen is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

7. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.

8. Termination

8.1 Termination by You

• You may stop using AllOpen at any time by deleting your account through your profile settings.
• Upon account deletion, your User Content may be permanently deleted, except where we are required to retain it for legal purposes.

8.2 Termination by Us

• We may suspend or terminate your account and access to the Service immediately, without prior notice, if you violate these Terms or engage in conduct that we determine is harmful to other users, the Service, or our reputation.
• We may also terminate your account if it has been inactive for an extended period.
• Upon termination, your right to use the Service will immediately cease.

9. Disclaimers and Limitation of Liability

9.1 Service Provided "As Is"

• AllOpen is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
• We do not guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
• We do not warrant that any defects or errors will be corrected.

9.2 Limitation of Liability

• To the maximum extent permitted by law, Allpixel Technologies and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Service.
• Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless Allpixel Technologies and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

11.2 Dispute Resolution Process

• If you have a dispute with us, you agree to first contact us at contact@allpixel.in to attempt to resolve the dispute informally.
• If we cannot resolve the dispute informally within 60 days, any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 (India), or as otherwise required by applicable law.
• The arbitration shall be conducted in English and shall take place in India.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or for other reasons. We will notify you of any material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending you an email notification (for significant changes)
• Displaying a notice in our Service

Your continued use of AllOpen after such changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Allpixel Technologies regarding your use of AllOpen and supersede all prior agreements and understandings.
